4. General Refund Policy
HTBG reviews refund requests on a case-by-case basis.
Refund eligibility will depend on the circumstances of the request, including:
- The nature of the service purchased.
- The applicable proposal, quotation, or signed agreement.
- Whether work has commenced or been completed.
- The value of work performed and deliverables provided.
- Payments received and milestones completed.
- Third-party expenses and other legitimate project commitments.
- Any applicable service-specific refund or cancellation terms.
- Applicable statutory and contractual rights.
Depending on the circumstances, an eligible resolution may include a full refund, partial refund, credit toward future services, completion of outstanding work, or another mutually agreed arrangement.
Payment of an advance, deposit, milestone amount, or service fee does not automatically guarantee a refund. Equally, the fact that a payment has been made or work has commenced does not, by itself, eliminate any refund entitlement that may exist under the applicable agreement or law.
HTBG will assess the relevant facts and communicate the outcome of a refund request to the client.
5. Advance Payments and Deposits
HTBG may require an advance payment, deposit, onboarding payment, or initial milestone payment before commencing a project or allocating resources.
Such payments may support project planning, research, design, development, personnel allocation, configuration, or the purchase of approved third-party products and services.
If a client requests cancellation or a refund after making an advance payment, HTBG will consider:
- Whether project work has commenced.
- The value of work completed up to the relevant date.
- Resources allocated and commitments made for the engagement.
- Approved third-party expenses and costs that cannot reasonably be recovered.
- The payment and cancellation provisions of the applicable agreement.
- Any other relevant circumstances and applicable legal requirements.
Any deduction from a potential refund must be consistent with the applicable agreement and law and supported by the work performed, costs incurred, or other legitimate contractual obligations.
Where a refund is due, the refundable amount will be determined after the appropriate assessment.
6. Milestone-Based Payments
Certain projects may be divided into milestones, with payments linked to agreed project stages, deliverables, or completion criteria.
If a project is cancelled or terminated before completion, HTBG will assess the payments and outstanding obligations as follows:
6.1 Completed Milestones
Payments relating to completed milestones will be handled in accordance with the applicable agreement and applicable law, taking into account the work delivered and any relevant acceptance conditions.
6.2 Partially Completed Milestones
Where work has commenced but a milestone remains incomplete, HTBG will assess the work performed, agreed pricing structure, deliverables produced, and applicable contractual provisions.
6.3 Future Milestones
Amounts paid in advance for future work that has not been performed may be considered for a refund, subject to outstanding contractual obligations, approved expenses, and applicable law.
6.4 Outstanding Payments
If payment remains due for work performed or other obligations properly payable under the agreement, the client may remain responsible for those amounts, subject to the agreement and applicable law.
HTBG will communicate the basis of any applicable refund, credit, or outstanding balance to the client.
7. Project Cancellation Policy
Clients may request cancellation of a project in accordance with the applicable signed agreement, proposal, or written project terms.
Cancellation requests must be submitted in writing to [email protected], preferably with the relevant project or invoice reference.
7.1 Cancellation Before Work Begins
Where a client requests cancellation before project work begins, HTBG will review the request under the applicable agreement.
Any refund will be assessed based on the payments received, work already performed, preparatory activities, approved expenses, commitments made, and any applicable cancellation conditions.
Where no relevant work or recoverable commitment has been incurred, the refund will be assessed accordingly, subject to the applicable agreement and law.
7.2 Cancellation After Work Has Commenced
If a client requests cancellation after work has started, HTBG will assess the value of work performed, deliverables produced, resources committed, approved expenses, and contractual obligations up to the effective cancellation date.
The client may be responsible for payment for work completed and other amounts properly payable under the agreement and applicable law.
Any remaining amount will be reviewed for refund eligibility.
7.3 Cancellation After Delivery
Once a service or deliverable has been completed and supplied in accordance with the applicable agreement, cancellation will not ordinarily entitle the client to a refund for services already provided.
However, a request involving a material failure to meet the agreed scope, a deliverable that was not supplied, a deficiency in services, or another legally recognized ground for relief will be assessed on its merits.
Nothing in this section removes any rights or remedies available under applicable law.
7.4 Cancellation by Mutual Agreement
HTBG and the client may mutually agree in writing to cancel, suspend, or modify an engagement.
Any agreed refund, outstanding payment, delivery obligation, or other consequence of the cancellation should be documented in writing.
7.5 Cancellation by HTBG
If HTBG determines that it cannot continue an engagement, it will notify the client and handle the matter in accordance with the applicable agreement and law.
Depending on the circumstances, the parties may agree to complete outstanding obligations, transfer work where appropriate, modify the engagement, or provide a refund for eligible services not provided.
8. Recurring Services and Monthly Engagements
This section applies to recurring services, including digital marketing, SEO, maintenance and support, subscriptions, and dedicated developer or development team engagements.
8.1 Cancellation Notice
Clients must submit cancellation requests in accordance with the notice period and termination provisions specified in the applicable agreement.
If no notice period is specified, the parties should agree on a reasonable cancellation date in writing, subject to applicable law.
8.2 Current Billing Period
Charges for the current billing period will be assessed in accordance with the agreed billing structure, services delivered, resources committed, and applicable contractual terms.
Cancellation does not automatically reverse charges for services already provided or obligations properly incurred.
8.3 Prepaid Services
Prepaid amounts relating to future services that will not be provided may be reviewed for a refund in accordance with the applicable agreement and law.
8.4 Automatic and Recurring Payments
Where recurring payments have been authorized, clients may request cancellation of future billing in accordance with the applicable service or subscription terms.
Cancellation of future billing does not automatically discharge outstanding invoices or other contractual obligations already incurred.
HTBG will handle cancellation requests and any applicable payment instructions in accordance with the agreement, payment-provider requirements, and applicable law.
9. Third-Party Services and Expenses
Certain projects may involve third-party products or services, including:
- Domain registrations and hosting.
- Cloud infrastructure and server services.
- Paid themes, templates, plugins, and software licences.
- APIs, external software tools, and subscriptions.
- Advertising platform expenditure.
- Stock images, videos, fonts, and other licensed assets.
- Other products or services procured for a client project.
Refund eligibility for such expenses will depend on the third-party provider’s terms, whether the expense has already been incurred, whether it is recoverable, and the applicable agreement and law.
HTBG cannot guarantee that a third-party provider will approve a refund.
Where a third-party refund is available and applies to a client-funded expense, HTBG will communicate the relevant outcome and handle any amount payable to the client in accordance with the agreement and applicable law.
No deduction will be made contrary to applicable legal requirements or the agreed contractual terms.
10. Design, Development, and Digital Deliverables
For custom software, websites, mobile applications, SaaS platforms, AI/ML solutions, blockchain projects, graphics, videos, and other digital deliverables, refund requests will be assessed according to the agreed scope of work and project circumstances.
Relevant factors may include:
- Work completed and deliverables supplied.
- Agreed milestones and acceptance criteria.
- The nature and extent of any alleged deficiency.
- The agreed revision and change-request process.
- The status of testing, deployment, or delivery.
- The applicable service agreement and legal requirements.
Requests for additional features, changes in specifications, or work outside the agreed scope will be handled through the applicable change-request process.
A change in requirements does not automatically entitle a client to a refund. However, any claim involving a material failure to provide the contracted service will be reviewed on its merits.
11. Client Delays and Failure to Provide Required Information
Clients are responsible for providing the information, content, approvals, credentials, access, and other materials reasonably required for their projects.
If a client delays providing required information, approvals, feedback, or access, the agreed project schedule may be affected.
Such delays do not automatically create a right to a refund or eliminate payment obligations for work performed or commitments properly incurred.
Where delays significantly affect the engagement, HTBG may discuss revised timelines, suspension, or cancellation with the client in accordance with the applicable agreement and law.
Any additional charges or consequences arising from such delays must be consistent with the applicable agreement and applicable legal requirements.
12. Refund Requests for Billing Errors or Service Concerns
Clients may request a refund review for circumstances including:
- Duplicate payments.
- Incorrect or unauthorized charges, subject to verification.
- Services paid for but not provided.
- Material discrepancies between the agreed scope and the services supplied.
- Project cancellation or termination where a refund may be due.
- Other legitimate billing or service-related concerns.
HTBG will review each request based on the supporting information, applicable agreement, and relevant legal requirements.
Where an error or eligible refund is established, HTBG will take appropriate steps to resolve the matter.
13. How to Request a Refund or Cancellation
To submit a refund request or cancellation notice, clients should email [email protected] or contact HTBG using the business contact details listed in this Policy.
Please provide the following information:
- Full name or registered business name.
- Contact email address and phone number.
- Project or service name.
- Invoice number, order reference, or transaction ID.
- Payment date and amount.
- Reason for the refund or cancellation request.
- Relevant supporting documents or correspondence, where available.
HTBG may request additional information reasonably necessary to review the request.
Receipt of a request does not automatically constitute approval of a refund. HTBG will review the circumstances and communicate its decision in accordance with the applicable agreement and law.
Where mandatory consumer grievance requirements apply, HTBG will comply with the applicable acknowledgment and resolution timelines.
14. Refund Processing Timeline
Once a refund has been approved, HTBG aims to initiate processing within 7–14 business days, subject to applicable contractual requirements and legal deadlines.
The time required for the funds to appear in the client’s account may vary depending on the payment method, bank, payment gateway, payment provider, currency, and international payment processing arrangements.
If additional verification or information is reasonably required, HTBG will inform the client.
The stated processing period is an operational target and does not override any shorter mandatory refund deadline imposed by applicable law.
15. Payment Gateway Fees and Currency Differences
Where a refund is approved, the treatment of transaction fees, foreign exchange differences, currency conversion charges, and other payment-related costs will be determined in accordance with the applicable agreement, payment-provider terms, and applicable law.
Any deduction or charge must have an appropriate contractual or legal basis and must not violate applicable consumer protection requirements.
For international payments, the amount credited to the client’s account may be affected by the receiving bank or payment provider’s currency conversion procedures.
16. Chargebacks and Payment Disputes
If a client believes a payment was processed incorrectly or that a refund is due, the client may contact HTBG to request a review.
Clients may also exercise any applicable rights available through their payment provider, bank, or under applicable law.
HTBG may provide relevant invoices, transaction records, project correspondence, delivery evidence, and other appropriate supporting documentation when responding to a payment dispute, subject to applicable law and privacy obligations.
Contacting HTBG directly is encouraged as it may help resolve a concern efficiently, but it does not restrict any legal rights or remedies available to the client.
17. Amendments to This Policy
HTBG may revise this Policy from time to time to reflect changes in its services, operational practices, contractual arrangements, or legal requirements.
Any revised version will be published on https://htbusinessgroup.com with an updated effective or revision date.
Changes will apply prospectively to the extent permitted by law. Existing signed agreements will continue to govern the relevant engagement unless the parties agree otherwise or applicable law requires a different outcome.
18. Governing Law and Dispute Resolution
This Policy is intended to be governed by the laws of India, subject to applicable mandatory legal requirements.
Disputes relating to this Policy will be addressed in accordance with the dispute-resolution provisions of the applicable service agreement and applicable law.
Nothing in this section is intended to exclude or restrict the jurisdiction of a court, consumer commission, regulatory authority, or other forum where such jurisdiction cannot legally be excluded or restricted.
